Tax Classification of Trading Activities

Under Income Tax law, trading in stock markets is classified based on product structure:

  • Intraday Equity Trading: Legally classified as Speculative Business Income under Section 43(5). Intraday losses can be set off ONLY against speculative profits and can be carried forward for 4 years.
  • Futures & Options (F&O) Derivatives: Legally classified as Non-Speculative Business Income under Section 43(5)(d). F&O losses can be set off against any income (except salary) and carried forward for 8 consecutive years.

How to Calculate F&O Turnover (Absolute Profit Method)

  1. Total trading turnover exceeds β‚Ή10 Crores (since 100% of trading transactions occur digitally via banking channels).
  2. Turnover is up to β‚Ή2 Crores, you declared net profits below 6% under Section 44AD in the past, and total income exceeds the basic exemption limit.

Mandatory Return Form: ITR-3

All intraday and F&O traders must compulsorily file ITR-3. You can claim genuine business expense deductions against trading revenue: brokerage charges, exchange transaction charges, SEBI turnover fees, charting software subscriptions (TradingView), internet bills, and laptop depreciation.
