GST Revocation: Restoration of Cancelled GSTIN via Form REG-21

When the GST Department initiates suo-motu cancellation of a taxpayer's GSTIN due to non-filing of consecutive returns for six months (or two quarters for QRMP scheme), conducting business from an unverified address, or obtaining registration through fraud, commercial operations grind to a complete halt. In such distress situations, the GST law provides a legal remedy under Section 30 of the CGST Act known as Revocation of Cancellation of Registration.

Statutory Framework & Key Operational Rules

Under current GST rules, a registered taxpayer whose registration has been cancelled by the Proper Officer can apply for revocation by filing Form GST REG-21 within 90 days from the date of the service of the cancellation order. The law empowers the Joint or Additional Commissioner to extend this deadline by an additional 180 days upon demonstrating sufficient cause. Before filing Form GST REG-21, the taxpayer must unconditionally clear all pending statutory returns up to the effective cancellation date, pay all outstanding taxes, penal interest under Section 50, and accrued late fees under Section 47.
